Saisi sur renvoi après cassation, la CCIP-CA a considéré que le litige portant sur les conditions de la garantie applicable en vertu d'un contrat d'assurance conclu entre une société et une compagnie d'assurances toutes deux de droit polonais devait être soumis, en application des règles générales de droit international privé en matière d'obligations contractuelles ici applicables, à la loi polonaise (§ 51 à 60). La cour a rejeté la demande visant à écarter tant sur le fondement de la loi de police (§ 44 à 48) que sur celui de l'ordre public international (§ 61 à 68) cette loi au profit de la loi française.

3 November 2020 - ICCP-CA - RG 19/17529 – Insurance - conditions of guarantee - applicable law - French mandatory provisions and French international public policy 

The ICCP-CA, which was seized on referral after a proceeding before the French Cour de cassation, held that the dispute concerning the conditions of the guarantee applicable under an insurance contract concluded between an insurance company and a company both governed by Polish law should be subject to Polish law, pursuant to the general rules of private international law on contractual obligations applicable in this case (§§ 51 to 60). The court dismissed the claim to set aside this law in favor of French law, on the basis of both French mandatory provisions (§ 44 to 48) and French international public policy (§ 61 to 68).
