3 juin 2020 CCIP-CA RG 19/03758-Détermination de la loi applicable- loi française ou loi algérienne

La CCIP-CA a été saisie de l'appel d'une décision du tribunal de commerce de Paris ayant retenu l'application de la loi algérienne à la relation commerciale intervenue entre une société algérienne Sodmilab et une société française Waters portant sur la distribution de produits de marque Waters exclusivement en Algérie interrompue à l'initiative de la société Waters.

La CCIP-CA a infirmé la décision des premiers juges faisant droit à la demande de la société algérienne en retenant que la loi française était applicable quelle que soit la qualification de la relation commerciale revendiquée par la société algérienne, contrat d'agent commercial ou de distribution, en application de la Convention de la Haye 14 mars 1978 et des règlements européens Rome I et Rome II.

 La CCIP-CA a considéré que l'article L.442-6, I, 5° du code de commerce ne constitue pas une loi de police au sens de l'article 9 du règlement Rome I et a retenu qu 'il résultait des circonstances de la cause et des dispositions du contrat que les parties avaient entendu soumettre leurs relations commerciales au droit français .

June 3rd, 2020, ICCP-CA RG No 19/03758 - Determination of the applicable Law - French Law or Algerian Law

An appeal has been lodged with the ICCP-CA against a decision of the Paris Commercial Court which ruled for the application of Algerian law to the commercial relationship between an Algerian company, Sodmilab, and a French company, Waters, regarding the distribution of Waters branded products exclusively in Algeria, which was terminated at the initiative of Waters.

The ICCP-CA overturned the decision of the first judges ruling for the Algerian company's claim, holding that French Law was applicable regardless of the classification of the commercial relationship claimed by the Algerian company as a commercial agency or distribution contract, pursuant to the Hague Convention of 14 March 1978 and the European Regulations Rome I and Rome II.

The ICCP-CA  held that the provisions of Article L.442-6, I, 5° of the  French Commercial Code are not overriding mandatory provisions within the meaning of Article 9 of the Rome I Regulation and held that it resulted from the circumstances of the case and the stipulations of the contract that the parties had intended to submit their commercial relations to French Law.
