Dans cette affaire, le conseiller de la mise en état a jugé irrecevable comme tardif l'appel d'un jugement du tribunal de commerce de Paris interjeté par deux résidents australiens qui contestaient la validité de la signification du jugement en raison d'une erreur d'orthographe dans leur nom patronymique figurant sur le jugement et sur les actes de signification. Après avoir jugé qu'il s'agissait d'une erreur matérielle ne faisant pas obstacle à la signification du jugement, le conseiller de la mise en état a jugé les significations régulières au regard des dispositions de la Convention de La Haye du 15 novembre 1965 relative à la signification et à la notification à l'étranger des actes judiciaires et extrajudiciaires en matière civile et commerciale, applicable entre la France et l'Australie et des exigences formelles prescrites par l'État requis.

In this case, the pre-trial judge ruled inadmissible as late the appeal of a judgment of the Commercial Court of Paris filed by two Australian residents who challenged the validity of the service of the judgment because of a mistake of spelling in their patronymic name appearing on the judgment and the deeds of service. Having found that this was a material error and did not preclude the service of the judgment, the pre-trial judge  found the service to comply with the provisions of the Hague Convention of 15 November 1965 on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters, applicable between France and Australia and according to the formal requirements prescribed by the requested State.
