7  janvier 2020, CCIP-CA RG n°19/07260 – sentence arbitrale internationale - mission de l'arbitre. 

Rejetant le recours en annulation formé par la République Démocratique du Congo contre une sentence arbitrale internationale reprochant principalement au tribunal arbitral d'avoir statué sans se conformer à la mission qui lui avait été confiée à défaut pour ce tribunal d'avoir selon la RDC fait une application d'une jurisprudence de la Cour Suprême de cet Etat quant à l'appréciation des pouvoirs du Président de la République pour approuver ou non une convention pétrolière, la CCIP-CA a relevé, d'une part que le tribunal arbitral avait bien fondé sa décision sur le droit de la République Démocratique du Congo et, d'autre part, qu'il s'était appuyé expressément sur la jurisprudence de la Cour Suprême de Justice citée par la RDC pour expliciter sa décision de sorte que si le tribunal arbitral était tenu d'appliquer le droit de la RDC, ce qu'il a fait, il ne s'écartait pas de sa mission en se livrant à une interprétation de celui-ci.

7 January 2020, ICCP-CA RG n°19/07260 - International arbitral award - Arbitrator's mission 

Ruling out  the action for annulment brought by the Democratic Republic of the Congo against an international arbitral award mainly accusing the arbitral tribunal of having ruled without complying with the mission entrusted to it, failing, according to the DRC, to apply a case law of the Supreme Court of this State regarding the appreciation of the powers of the President of the Republic to approve or not an oil convention, the ICCP-CA held, on the one hand that the arbitral tribunal had ruled on the ground of the law of the Democratic Republic of Congo and, on the other hand, that he had expressly relied upon the case law of the Supreme Court of Justice cited by the DRC to explain its decision so that if the arbitral tribunal was required to apply the law of the DRC, which it did, it did not depart from its mission by engaging in its interpretation.
