CCIP-CA arrêt du 15 janvier 2019. Dans une affaire portant sur la mise en cause de la responsabilité contractuelle d'une société de transport, à la suite de la disparition de deux colis d'objets précieux devant être transportés de Colombie vers la France, la Chambre commerciale internationale de la cour d'appel de Paris, qui lors de son audience du 3 décembre 2018 avait, conformément au protocole signé avec le barreau de Paris, procédé contradictoirement à l'audition d'une partie, a, par arrêt du 15 janvier 2019, après avoir écarté l'application de la Convention internationale de Montréal signée le 28 mai 1999 relative au transport aérien, les faits à l'origine du dommage étant survenus à l'occasion de leur livraison au cours du transport routier des colis en France, retenu la responsabilité contractuelle du transporteur et estimé qu'en raison d'une faute inexcusable caractérisée, celui-ci ne pouvait opposer à son client les clauses limitatives de responsabilité figurant dans les conditions générales de transports.

ICCP-CA Judgement of 15th January  2019- In a case where the contractual liability of a transport company was questioned following the disappearance of two parcels of precious objects to be carried from Colombia to France, the International Commercial Chamber of the Paris Court of Appeal, which heard a party at the hearing of the 3rd of December 2018 in accordance with the protocol signed with the Paris Bar, ruled out in a judgement dated 15th January 2019 the application of the Montreal Convention of 28 May 1999 on Carriage by Air, considering that the harmful event occured during the delivery of the parcels in France by road transport. The ICCP-CA ruled for the contractual liability of the carrier and found that the limited liability clause in the general conditions of carriage was unforceable against the client in view of the unexcusable conduct of the carrier.
