La CCIP-CA était saisie de trois appels interjetés contre une ordonnance ayant conféré l’exequatur en France à un « jugement arbitrage » rendu à Genève dans un litige opposant l’État de Libye à trois sociétés suisses.

La cour a infirmé l’ordonnance et rejeté les demandes d’exequatur.

Elle a considéré que le consentement de l’État de Libye à l’arbitrage faisait défaut dès lors que la demande d’arbitrage, qui ne comportait aucune identification des sociétés concernées, avait été signée par des personnes se prévalant d’un mandat ne comportant aucun pouvoir pour compromettre.

The ICCP-CA was seized of three appeals against an order conferring exequatur in France to an "arbitration judgment" rendered in Geneva in a dispute between the State of Libya and three Swiss companies.

The court overturned the order and dismissed the applications for exequatur. 
 
It considered that the consent of the State of Libya to arbitration was lacking since the request for arbitration, which did not include any identification of the companies concerned, had been signed by persons relying on a mandate with no power to compromise.
