La CCIP-CA était, dans cette affaire, saisie de l’appel interjeté par une société russe  contre un jugement du tribunal de commerce de Paris ayant rejeté son exception d’incompétence au profit de la juridiction russe dans un litige l’opposant à une société allemande introduit en France sur le fondement d’une clause attributive de juridiction au profit des juridictions de Paris.

La cour ayant retenu que l’action engagée concernait bien l’exécution du contrat dans lequel figurait la clause litigieuse a confirmé la décision des premiers juges déboutant la société russe de toutes ses contestations concernant la validité de la clause sur la forme et le fond, au regard respectivement des conditions posées à l’article 25 §1 du règlement Bruxelles 1bis et du  droit interne.

The ICCP-CA was seized of an appeal lodged by a Russian company against a judgment of the Paris Commercial Court having dismissed its objection to jurisdiction under a dispute between that Russian company and a German company submitted to the French juridiction on the grounds of a clause conferring jurisdiction to the Paris courts.

Holding that the action brought concerned the performance of the contract in which the clause at issue was, the ICCP-CA upheld the judgment of the Paris Commercial Court and dismissed the Russian company from all its claims about the validity of the clause on form and substance, under the conditions specified, respectively, by Article 25 §1 of the Brussels 1bis Regulation and by the domestic law.
