Sur le recours en annulation d 'une sentence arbitrale qui avait mis à la charge de la société X une certaine somme en réparation d'un manquement contractuel vis-à-vis de la société Y, fondé sur la violation du principe de la contradiction et de l'égalité des armes et d'une atteinte à l'ordre public international, la cour n'a pas fait droit à la demande de la société X. La cour a considéré sur le premier moyen que  l'Arbitre avait conduit la procédure en respectant un juste équilibre entre le droit de la société Y de voir examiner ses prétentions dans un délai raisonnable et le droit de la société X d'organiser utilement sa défense et que le second moyen tendait à la révision au fond de la sentence ce qui n'entre pas dans le pouvoir du juge de l'annulation.

On an application to set aside an arbitral award which had ordered X. to pay a certain sum to compensate Y. for a contractual breach, based on both the violation of the adversarial and equality of arms principles and on an infringement of international public policy, the court dismissed X.'s action. On the first ground, the court considered that the Arbitrator had conducted the proceedings with a fair balance between the right of Y to have its claims examined within a reasonable time and the right of X to usefully organize its defense. On the second ground, the court considered that it aimed at the revision of the merits of the award, which is not within the power of the annulment judge.
