Dans cette affaire, la CCIP-CA a rejeté le recours en annulation d'une sentence partielle. Elle a écarté le grief tiré du non-respect d'une clause de conciliation préalable après avoir rappelé qu'il s'agit d'une question relative à la recevabilité des demandes qui n'entre pas dans les cas d'ouverture du recours en annulation énumérés par l'article 1520 du code de procédure civile (§ 34). La Cour a également rejeté le grief tiré de la violation  du  principe  d'exécution  de  bonne  foi  des conventions, estimant que ce grief invitait la Cour à réviser  au fond la sentence partielle, ce qui est prohibé, même à l'occasion de l'examen d'un moyen tiré de la méconnaissance de l'ordre public international (§39). Enfin, la Cour a écarté le grief tiré du non-respect du principe d’égalité des armes. Le demandeur au recours reprochait à cet égard au tribunal arbitral de l'avoir privé d'une expertise contradictoire en refusant de faire application de la clause de conciliation préalable.  La Cour a estimé que ce grief revenait également à solliciter la révision de la sentence partielle sur ce point  (§45).

In this case, the ICCP-CA dismissed the appeal seeking to set aside a partial award. The Court dismissed the claim based on the failure to comply with a prior conciliation clause, after recalling that this is a question relating to the admissibility of claims which does not fall within the scope of an action for annulment listed in article 1520 of the Code of Civil Procedure (§34). The Court also dismissed the claim based on the violation of the principle of good faith in the performance of agreements, holding that this claim invited the Court to review the merits of the partial award, which is prohibited, even when examining a plea alleging the violation of international public policy (§39). Finally, the Court dismissed the claim alleging a failure to comply with the principle of equality of arms. In this respect, the claimant alleged that the arbitral tribunal deprived it of an adversarial investigation by refusing to apply the prior conciliation clause. The Court held that this claim also amounted to requesting a review of the partial award on this point (§45).
