Saisie d’un appel contre la décision du tribunal de commerce qui avait rejeté la qualification de contrat d’agent commercial entre la société CMC de droit tunisien et la société Monaco Logistique qui achemine des marchandises en Tunisie, la cour a confirmé la décision des premiers juges en retenant qu’à l’examen des pièces produites,  le contrat avait établi une relation de sous-traitance de transport qui n’ouvrait pas droit en cas de rupture, aux indemnités prévues pour l’agent commercial.

Elle a confirmé la décision des premiers juges ayant fait droit à une indemnité sur le fondement du caractère brutal  de la relation commerciale établie.

Seized of an appeal against a Paris commercial court’s decision which had rejected the qualification of commercial agent contract between the Tunisian company CMC and the company “Monaco Logistique” which transports goods in Tunisia, the court upheld the decision of the first judges by holding that on examination of the documents produced, the contract had established a subcontracting transport relationship which did not open right, in case of a breach of contract, to the compensations planned for the commercial agent.

The court upheld the decision of the first judges having granted compensation on the basis of the brutal nature of the commercial relationship established.
