22.03.2022 – CCIP-CA - RG 19/09863 – recours en annulation – sentence internationale - arbitrage d’investissement - rejet

Saisie d’un recours en annulation contre une sentence internationale statuant sur le fondement d’un traité bilatéral d’investissement entre la république de Chypre et le Liban , la cour a rejeté le recours formé par les recourants  libanais qui opposaient l’incompétence du tribunal arbitral, la méconnaissance de sa mission, et du principe de contradiction ainsi que la violation de l’ordre public international.

La cour a considéré en substance que le tribunal arbitral n’avait pas statué sur une question de compétence ( point 32)  que les recourants n’ établissaient pas que le tribunal avait statué à partir d’éléments auxquels ils n’avaient pas eu accès  ( point 50) et que pour ces motifs la violation de l’ordre public international n’était pas caractérisée.

Seized of a proceedings seeking the setting aside of an arbitral award ruling on the basis of a bilateral investment treaty between the Republic of Cyprus and Lebanon, the court rejected the claim made by the Lebanese claimants who raised objections as to the arbitral tribunal’s lack of jurisdiction, the disregard of its mission and of the principle of contradiction, as well as the violation of the international public order.

The court considered in essence that the arbitral tribunal had not ruled on a jurisdiction question (point 32), that the claimants did not establish that the tribunal had ruled based on elements to which they did not have access (point 50), and that on these grounds the violation of the international public order was not established.
