22-02-2022 - CCIP-CA – RG 19/05045 - Recours annulation partielle de la sentence arbitrale internationale - non-conformité de la mission (oui) - violation de l’ordre public international (non) - accueil partiel.

La cour saisie d’un recours en annulation contre une sentence arbitrale internationale formée contre certains chefs décisoires, a fait droit partiellement à la demande en retenant que le montant de la somme allouée au titre de la condamnation  n’avait pas été demandé et que le tribunal arbitral avait dès lors statué en dehors de sa mission.

L’annulation de la condamnation ayant pour effet de priver d’effet la sentence dans l’ordre juridique français, aucune violation de l’ordre public international n’a été caractérisée et les autres chefs de la décision n’ont pas été annulés.

The court hearing an action for setting aside an international arbitration award against some of the decisions included in this award, partially granted the request, holding that the amount of the award had not been requested and that the arbitral tribunal had therefore ruled outside its mission.

As the setting aside of the award denied any effect of the award in the French legal system, no violation of international public policy was found and the other heads of the decision were not annulled.
