La CCIP-CA était, dans cette affaire, saisie d’un recours en annulation contre une sentence au terme de laquelle le tribunal arbitral, saisi sur le fondement du Traité Bilatéral d’Investissement sur la promotion et la protection des investissements entre le Royaume Uni de Grande Bretagne et d’Irlande du Nord et République Orientale d’Uruguay, s’était déclaré incompétent.

L’instance avait été introduite par des citoyens britanniques contre l’Etat d’Uruguay pour manquement à ses obligations au titre du Traité concernant un projet d’exploitation de gisements de minerai de fer en Uruguay non abouti .

Les demandeurs à l’arbitrage agissaient en tant que bénéficiaires d’une Fiducie familiale située aux Iles Caïmans.

La CCIP-CA a considéré que les motifs retenus par le tribunal arbitral fondés sur la condition temporelle du Traité n’étaient pas justifiés pour rejeter sa compétence,  s’agissant d’apprécier une condition de fond de la protection prévue au Traité et non une condition procédurale tenant au consentement à l’arbitrage.

Elle a en conséquence annulé la sentence, aucune autre raison alléguée par l’Uruguay ne faisant obstacle à la compétence du tribunal arbitral.

In this case, the ICCP-CA was seized of an application for the setting aside of an arbitral award in which the arbitral tribunal, seized on the basis of the Bilateral Investment Treaty for the promotion and protection of investments between the United Kingdom of Great Britain and Northern Ireland and the Oriental Republic of Uruguay, declared it lacked jurisdiction.

Initially, the case was brought by British citizens against the State of Uruguay for its failure to fulfill its obligations under the Treaty in relation to an unsuccessful iron ore mining project in Uruguay.

The claimants in the arbitration were acting as beneficiaries of a family trust located in the Cayman Islands.

The ICCP-CA considered that the reasons given by the arbitral tribunal based on the temporal requirement of the Treaty did not justify its decision of lack of jurisdiction, as the tribunal was assessing a substantive requirement of the protection provided for in the Treaty and not a procedural requirement relating to the consent to arbitration.

The ICCP-CA therefore set aside the award, as no other reason alleged by the State of Uruguay precluded the jurisdiction of the arbitral tribunal.
