La CCIP-CA était saisie d’un recours en annulation contre une sentence internationale rendue à Paris dans un litige opposant deux sociétés de droit grec.

La cour n’a pas fait droit aux moyens tirés de l’irrégularité de la constitution du tribunal et de la violation de l’ordre public international, tous deux fondés sur le même grief du défaut d’indépendance et d’impartialité d’un des arbitres.

Après avoir déclaré ces moyens recevables, la cour a relevé qu’aucun des faits invoqués au soutien du recours n’établissait un manquement de l’arbitre de son obligation de révélation.

Le recours a été intégralement rejeté.

The ICCP-CA had before it an action to annul an international award rendered in Paris in a dispute between two Greek companies.

The Court did not uphold the pleas based on the irregularity in the constitution of the tribunal and breach of international public policy, both based on the same complaint regarding the lack of independence and impartiality of one of the arbitrators.

After declaring these pleas admissible, the court noted that none of the facts put forward in support of the appeal established a breach by the arbitrator of his obligation to disclosure.

The appeal was entirely dismissed.
