18 mai 2021- CCIP-CA- RG 19/22026 -contrat de distribution entre une société française et une société belge - validité d'une clause minimale d'achat -étendue du préjudice réparable- droit français applicable

Dans cette affaire la CCIP-CA saisie d'un appel contre un jugement du tribunal commerce de Paris du 17 octobre 2019 a infirmé partiellement la décision retenant que le manquement contractuel au contrat de distribution était valablement établi et que la société distributrice qui avait failli à son obligation d'approvisionnement devait réparer le préjudice subi par le fournisseur par ce manquement sans qu'il y ait lieu de l'assortir d'une obligation de livraison des produits en contrepartie. Le montant des dommages et intérêts au titre du préjudice a été évalué au regard des engagements pris et des ventes qui auraient pu être réalisées.

In this case, the ICCP-CA heard an appeal against a judgment of the Paris Commercial Court  of 17 October 2019 and overturned partially the decision, holding that the contractual breach of the supplier contract was validly established and that the distributing company, which had failed in its duty to supply, had to repair the supplier for the damage suffered as a result of this breach, without having to include an obligation to deliver the products in return. The amount of the damages was evaluated regarding the commitments made and the sales that could have been made.
