Saisie de l’appel d’une décision du tribunal de commerce qui avait mis à, la charge d’une société française commercialisant des vêtements, le montant de factures impayées correspondant à des commandes de collections fabriquées en Inde et livrées par une société indienne en France, la cour a confirmé la décision des premiers juges mettant à la charge de la société française les sommes demandées.

La cour après avoir retenu l’application du droit français au litige relatif à des opérations commerciales internationales, a considéré que les sommes en paiement demandées étaient justifiées et qu’aucun élément ne rapportait la preuve des manquements dans les livraisons alléguées par l’appelante qui a, en conséquence, succombé dans son appel.

The CCIP-CA was seized of a decision of the Commercial Court which had charged a French textiles company, the amount of unpaid invoices corresponding to collection made in India and delivered by an Indian company in France, the court confirmed the decision of the trial judges putting at the expense of the French company the sums requested.

The Court having upheld the application of French law to the dispute concerning international commercial transactions, considered that the amounts requested for payment were justified and that there was no evidence of non-compliance in the deliveries alleged by the appellant, who therefore succumbed in its appeal.
