11.01.2022- CCIP-CA – RG 20/15869 –-  appel d’un jugement civil du tribunal judiciaire de Paris - reconnaissance de la qualité de débiteur et fixation de la créance avec intérêts -décisions étrangères - infirmation partielle- décision réputée contradictoire

La CCIP-CA était saisie de l’appel formé par les ayant

s droits  de M. XX résident au Bénin créancier d’une société Bélipêche  liquidée au Bénin dont la créance avait été définitivement reconnue par décision de la cour d’appel de Cotonou  du  3 février 2000. L’Etat béninois actionnaire de la société avait repris les dettes et les créances  de ladite société en vertu d’un décret  n° 2001-563 de la République du Bénin du 28 décembre 2001 ;

La cour a fait droit  à l’appel des ayants droits qui tendaient à faire reconnaitre l’ Etat du Bénin débiteur des sommes dues aux lieu et place de la société Bélipêche. La cour a en conséquence  fixé la créance avec les intérêts en  distinguant  des intérêts au taux légal béninois des intérêts au taux légal français.

The ICCP-CA heard an appeal filed by the beneficiaries of M. XX resident in Benin creditor of the company Bélipêche liquidated in Benin of which the debt obligation had been definitively recognized by the decision of the court of appeal of Cotonou of February 3^rd, 2000. The Beninese state shareholder of the company Bélipêche had taken over the debts and claims of the said company pursuant to a decree no. 2001-563 of the Republic of Benin of December 28^th, 2001;

The court granted the appeal of the beneficiairies who tended to have the State of Benin recognized as the debtor of the sums due instead of the company Bélipêche. The court therefore determined the the sum due  with the interest by distinguishing between interest at the Beninese statutory rate and interest at the French statutory rate.
