3 mars 2020, CCIP-CA RG n° 19/12564 – Appel référé – publication d'un communiqué sur internet - dénigrement – compétence juridictionnelle 

Une société ayant son siège social en France a agi en référé devant le juge français pour mettre en cause la responsabilité délictuelle d'une société ayant son siège social au Royaume-Uni pour des agissements de concurrence déloyale à la suite de la diffusion par cette dernière sur son site internet d'un communiqué faisant état d'une décision rendue en sa faveur par un juge de la mise en état dans le cadre d'une action en contrefaçon de l'un de ses brevet et ayant prononcé en sa faveur une interdiction provisoire. La CCIP-CA, faisant application de l'article 7 § 2 du Règlement (UE) n° 1215/2012 du Parlement européen et du Conseil du 12 décembre 2012, après avoir rappelé les décisions de la CJUE du 7 mars 1995 (C-68/93) et du 21 décembre 2016 (C-618/15), a confirmé l'ordonnance du premier juge français ayant retenu sa compétence territoriale au regard non seulement de l'accessibilité en France du site internet sur lequel le communiqué litigieux a été publié, mais aussi du lien de rattachement particulièrement étroit avec la juridiction française résultant notamment de ce que le communiqué portait sur une procédure judiciaire en contrefaçon en cours en France contre une société ayant son siège en France et dont l'objet était de lui interdire de commercialiser en France certaines machines.  La CCIP-CA a également confirmé l'ordonnance du premier juge sur le fond après avoir considéré que la preuve d'un trouble manifestement illicite n'était pas en l'espèce rapportée.

3 March 2020, ICCP-CA RG n° 19/12564 - Appeal of summary judgment- publication of a press release on the Internet - disparagement- jurisdiction.

 A French company brought summary proceedings before a French court on the ground of the tortious liability of a British company for unfair competition conducts following the publication on its website of a press release disclosing a decision handed down in its favor by the pre-trial judge in an action for infringement of one of its patents and having issued in its favor a temporary prohibition. The ICCP-CA, applying Article 7 § 2 of Regulation (EU) n° 1215/2012 of the European Parliament and the Council of 12 December 2012, after having pointed out the decisions of the CJEU of 7 March 1995 (C-68/93) and of 21 December 2016 (C-618/15), upheld  the decision of the first French judge having accepted its territorial jurisdiction with reference to both the accessibility in France of the website on which the disputed press release was published and to the particularly close connection with French jurisdiction resulting in particular from the fact that the press release concerned legal proceedings for infringement in France against a company having its registered office in France and aiming at prohibiting it from marketing certain machines in France.  The ICCP-CA also upheld the order of the first judge on the merits after finding there was no evidence of a manifestly unlawful disorder in this case.
