Dans cette affaire, la CCIP-CA était saisie d'un appel contre des ordonnances d'exequatur, fondé sur un moyen d'annulation tiré de l'incompétence de l'arbitre. Cet appel a été rejeté par la cour qui a considéré qu'au regard des termes de la clause compromissoire qui désigne la LCIA – London Court of International Arbitration, pour trancher tout différend, « découlant de » la lettre d'accord « ou en rapport avec celle-ci », le tribunal arbitral était bien compétent pour statuer sur le litige.

2 February 2021 - ICCP-CA – RG 20/01789 – appeal against exequatur orders – jurisdiction of the arbitral tribunal
In this case, the ICCP-CA was seized with an appeal against exequatur orders, based on a plea of lack of jurisdiction of the arbitrator. The Court ruled out the appeal, finding that in light of the wording of the arbitration clause referring to the LCIA – London Court of International Arbitration, to settle any dispute, “arising out of” or “in connection with” the letter of agreement, the arbitral tribunal had jurisdiction to settle the dispute.
