Dans cette affaire la CCIP-CA était saisie d’un recours en annulation d’une sentence arbitrale. La cour ayant constaté l’accord des parties, a ordonné une médiation judiciaire, fixant la consignation directement entre les mains du médiateur, faisant ainsi courir le délai prévu pour la médiation, et a renvoyé l’affaire pour, le cas échéant, homologuer l’accord intervenu, et en cas d’échec de la médiation, entendre les parties en leur plaidoirie.

In this case the ICCP-CA was seized of an action for setting aside an arbitration award. The court, aknowledging the agreement of the parties, ordered a judicial mediation, fixed and ordered the deposit to be paid directly to the mediator, thus starting the time limit provided for the mediation, and referred the case back to the court in order to approve the mediation agreement reached, as the case may be , or, in case of failure of the mediation, to hear the parties in their pleading.
