Sur le recours en annulation d 'une sentence arbitrale qui avait condamné un Etat à payer une certaine somme en réparation d'un manquement contractuel vis-à-vis de deux sociétés étrangères,  fondé sur la violation du principe de loyauté procédurale et sur la violation de l'ordre public international, en ce que la sentence donnerait effet à un contrat entaché de corruption, la cour n'a pas fait droit à la demande de l'Etat.

La cour a considéré sur  le premier grief qu'en l'absence de fraude, le non-respect de la loyauté probatoire alléguée n'ouvrait pas un moyen d'annulation de la sentence et sur le second grief que la preuve d'indices graves précis et concordants de l'existence d'une corruption n'était pas établie.

On the action to set aside an arbitral award which had ordered a State to pay a certain amount in compensation for a breach of contract vis-à-vis two foreign companies, based on the violation of the principle of procedural fairness and on the violation of international public policy, on the ground that the award would give effect to a contract tainted by corruption, the court dismissed the State's action.

On the first claim, the court held that in the absence of fraud, the alleged lack of compliance with the principle of procedural fairness could not be a ground to set aside the award and on the second claim that the proof of precise, serious and concordant indications of corruption had not been established.
